Research Abstract
本研究は、「財」をめぐる状況の変容を踏まえた上で、財産権論の基本的再構成を目指すものである。現代日本における不動産の「負財」化、デジタル化による財の産出可能性の増大、シェアリング・エコノミーの進展といった状況は、物に対する排他的・恒久的支配としての「近代的所有権」を問い直す必要を生み出している。本研究は、財産権の基本的な存在理由―人格的自由の確保と資源配分の効率性―に立ち返り、財産権論の射程・内容・役割規定について再検討する。
