Research Abstract
本研究は、個別行政法に関する最新の知見をふまえて、新たな行政争訟制度を構想し、制度改革のための具体的提言を行うことを目的としている。 個別行政法分野の研究が独立・分化する中、行政争訟制度を対象として領域横断的な研究はこれまでほとんど行われてこなかった。本研究は、個別行政法分野における最新の研究成果を行政争訟制度の改革に役立てようとする、これまでにない斬新活独創的な試みであり、この点で学術的独自性と創造性を有する。 さらに、本研究により、行政法総論と個別行政法の間、さらには、各個別行政法の間においても、学問的交流が活発となり、行政法学のみならず、法学全体の活性化にもつながることが期待される。
