Research Abstract
本研究は、①競争法、②共同規制、③事前規制、④AI規制という視角から、ドミナントなDPに対する規律のあり方と、生成AIを中心としたデジタル技術の発展に法はいかに対応すべきかを検討することを目的とするものである。 より具体的には、競争法（独占禁止法制）や共同規制（取引透明化法、EUのP2B規則等）の有効性と限界、事前規制の可能性（EUのデジタル市場法、英国のSMS規制法案、ドイツ競争制限禁止法の第10次改正等）、AI規制の行方（EUのAI規則案等）という視角から、デジタルプラットフォームと生成AIをはじめとする人工知能に対する規律のあり方を検討するものである。
