Research Abstract

本研究は、嫡出推定制度に関して理論的に指摘されてきた問題、とりわけ「推定の及ばない子」の理論的扱いと、嫡出推定制度が戸籍実務において機能する仕方とをとりあげ、その両者に共通する課題を抽出して理論的に検討するものである。これにより、嫡出推定制度と戸籍制度とのあるべき相互関係を明らかにし、理論的課題と社会的課題の双方に対する適切な対応を提示することを目指している。
