Research Abstract
本研究は、国家による執行を前提としない古代および中世の西洋世界において、民事執行および判決の履行がいかにして行われたかを明らかにする試みである。古代ローマ法および中世ローマ・カノン法を素材とし、民事執行それ自体のみならず、民事執行に関わる周辺的法制度や、政治体制や裁判制度に基づく任意履行を促す仕組みにも着目し、権利実現のシステムを包括的・多面的に検討する。
