従来,医師法第17条に違反すると考えられていた行為が,適法と理解されるようになった事例が生じてきた。それは,看護師による静脈注射,救急救命士等による除細動器の使用,救急救命士による気管挿管と家族以外の者によるたんの吸引である。看護師による静脈注射と救急救命士による気管挿管は,絶対的医行為として医師のみが行える行為であったが,医師の指示の下に行える相対的医行為と捉えられるようになった。救急救命士等による除細動器の使用と家族以外の者によるたんの吸引は,資格を有する者しかできなかったものを,無資格者でも,講習等を受講することによって,一定の者にその行為を認めるようになった。そこには,医行為に関する新しい流れが感じられる。また,医行為と関連性の高い医業類似行為についても,このような流れを受けて,変化が見られるのか検討を試み,人の健康を害するかどうかによって分類する考えを示した。

Furthermore, it is essential that new classifications are established based on comprehensive assessment of the risks to the patients' health and well-being.
