Informal enforcement of the Anti-Monopoly Act, including warnings, guidelines and consultation,helps supplement formal action. But it also brings risks. Inappropriate informal enforcementdisrupts leg itimate business activities. Failure of informal action can lead to a decrease or even total loss of credibility of the agency enforcing the law -- the Fair Trade Commission -- thereby causing substantial damage. As long as informal enforcement has a positive outcome, abandoning it is not an option. Thus, such enforcement requires awareness of risks -- not merely knowing what they are, but grasping them comprehensively and practically. The enforcement requires identification of risks and their causes in each phase. A concrete understanding of such risks is necessary for improving such enforcement.In this paper, various aspects of informal enforcement of the act are examined in depth.Risks involved are then explored concretely. Finally, ways to improve informal measures are suggested.
