A Comprehensive View of Max Weber’s Sociology of Law : The Confrontation between “Formal Law” and “Substantive Justice”

Max Weber’s sociology of law is characterized not only by its encompassing of a wide range of time from ancient times to modern times, but also by its comparative study of cultures all over the world. This paper takes these factors into account, and tries to show a comprehensive view of his ideas. When only unambiguous general characteristics of the facts of the case are taken into account, the law is considered “formal”. In contrast, “substantive justice” is a standpoint which arises when a specific ethical, utilitarian or political point of view is used as a basis for judgement. The confrontation between formal law and substantive justice could be considered to be the consistent axis throughout Weber’s sociology of law. Chapter 1 considers two German keywords: “formal” [in English: formal] and “material” [in English: substantive] as Weber’s writings on these seem to be complicated and difficult to understand. Chapter 2 clarifies what Weber described as the distinction between the legal and the sociological points of view and on the distinction among “Sitte” [custom], “Convention” [convention] and “Recht” [law] in Weber’s text titled Die Wirtschaft und die Ordnungen [The Economy and Social Norms]. Weber’s text titled Die Entwicklungsbedingungen des Rechts [The Conditions of the Development of Law] is a historical survey of law paying attention to the types of the political structure and the relevant social strata. The center axis of the text is considered to be the confrontation between “formal law” and “substantive justice”. Chapter 3 clarifies the following content of this text: 1. A certain type of legal formalism was conditioned magically. 2. Later, it was conquered when “kadi-justice” by patrimonial sovereigns or the theocracy by the priesthood pursued substantive justice. 3. Under the bourgeois strata’s interest in the increasing calculability of the functioning of the legal process, formal law came into being. 4. However, this formal law has become contested by both modern legal professionals, who feel like formal law is a kind of “vending machine” that simply produces the same results when the same conditions are applied, and by the common people who demand escape from legally instituted property distribution frameworks. Pressure from these groups is an embodiment of the expectation for substantive justice to prevail. After the examination of some earlier literature on the subject of Weber’s sociology of law, I would finally like to point out the similarity and connection between Max Weber’s sociology of law and his sociology of religion. マックス・ウェーバーの法社会学は、古代から近代へと至る法の歴史的プロセスを考察対象としていること、また、全世界の文化を視野に入れた上で比較文化的考察を試みているところに特徴がある。本稿では、ウェーバーの法社会学を再考し、その全体像を示す。 　「もっぱら一義的で一般的な要件メルクマールのみが尊重される」のが「形式的な」法である。形式的な法の成立の一方で、これに反対して「実質的な」、すなわち、何らかの倫理的、功利的、あるいは政治的な価値基準に基づいて「正義」を主張する立場が成立する。形式的な法と実質的な正義との緊張関係が、法社会学を貫くテーマだと言ってよい。 　キーワードである「形式的（formal）」と「実質的（material）」という語に関して、ウェーバーの難解な文章をいかに読み解けばよいのかについて第一章で検討した。 　第二章では、法学的考察方法と社会学的考察方法との違いや、習俗と習律と法との区別についてのウェーバーのテキスト『経済と諸秩序』における見解を明らかにする。 　第三章では、法の歴史を様々な政治構造や担い手を意識しながら概観するウェーバーのテキスト『法の展開条件』の論述を、“「形式的な法」と「実質的な正義」との相剋”というテーマを軸として明らかにしてみる。1「魔術」に近い形態で「法形式主義」が成立するが、やがて、2家産制的君主の「カーディー裁判」、祭司による神政政治のもとで「実質的正義」が追求されるようになって、法形式主義は克服される。3「計算可能性」を求める市民層の利害関心のもとで形式的な法が成立する。4しかし、一方では「法自動販売機」になりさがりたくないという法実務家の願望、他方では不平等の法的正当化から脱却したいという民衆の願望のもとで、形式的な法は実質的正義への期待と対峙することになる。 　ウェーバー法社会学に関するいくつかの先行研究について検討したあと、最後に、ウェーバーの法社会学と宗教社会学との類似性・連動性を指摘する。
