Abstract

2016年1月から、マイナンバーの運用が開始された。情報化の進展により、ビッグデータを含む、産業、医療、学術研究等さまざまな分野での情報の分析・流通を容易にするための法制度の整備のため、2015年9月、個人情報保護法が改正された。誰も予想することができないほどの情報通信技術の進展に伴い、いまやインターネットの世界において、個人の自己情報コントロール権に関しては、その限界が議論され、脱自己情報コントロール権が謳われることも多くなった。そこで、個人情報保護法制と疾病登録の長い歴史を持つフィンランドの判例を参照しながら、わが国の診療情報の流通についての検討を試みた。

From January 2016, the system of My Number has been started in Japan. With the development of information technology, the Japanese Personal Data Protection Act was amended in September 2015 for maintenance of the legal system in order to facilitate the analysis and distribution of information in various fields, such as industrial, medical, academic research including the big data. With regard to the individuals’ self-information control rights, some people discuss the limits of them in the world of the Internet. Finland has a long history of personal information protection legislation and the medical register. So referring to the Finnish court's judgment, I have considered the Japanese patients’self-information control rights.
