説明

This note is commented to judgment of the Supreme Court in Japan February 9, 2004. In this case, the defendant swindled goods using credit cards under another person's name. When it was forgiven the use of the credit card by a nominee, he misjudged it. The Supreme Court made him the fraud. The whole judgment sentence is listed below 89 page of "Saikosai keizisaibannreisyu" Vol. 58 No. 2. My opinion supports the judgment which approved the fraud.
