夫婦の同姓が強調されたのはヨーロッパ近代が生み出した「近代家族」という場においてである。社会の公私の二領域の分離によって私的領域という制度的に脆弱な領域に組み込まれたこの家族は、「個人」を成員とし「愛」を絆とする。夫婦の同姓に見られる「家父長的」な性格もこの「愛」によって正当化されてきた。ヨーロッパにおける同姓制度の見直しは、すでに20世紀初頭より始まっている。日本において夫婦別姓制が（別姓選択制という形態をとっているが）導入されようとしていることも、この歴史的流れの中でとらえられるべきである。別姓制の利点は夫婦間の平等だけではなく、離婚、再婚が増加する現状下の子どもの諸権利を守ることも忘れられてはならない。

It was in the ‘Modern Family’ produced in the modern Europe that wife's family name ought to be the same as her husband's. The ‘Modern Family’ is weakly institutionalized because it is taken in the private sphere brought by the dichotomy of society－the public sphere and the private sphere. Family members are ‘individuals’ bound by ‘love’, which makes people blind to the patriarchy in husband and wife taking the same family name. In Europe, the reconsideration of this institution started in the early 20th century. Japan's future introduction of husband and wife having different family names should be understood in this historical flow. It must not be noted that the advantages of this institutionalization lies not in the equality between husband and wife, but in the protection of of children's rights in the society where the number of divorces and remarries is increasing.
