Abstract

This article is a study on the revision of the Korean Constitution in 1954. Specifically, the purpose of this article is to find out what the 1954 Constitutional Amendment was about, and what democratic theories the ruling and opposition lawmakers used to justify each other's claims. The 1954 constitutional amendment features three characteristics: referendum system, the abolition of the prime minister system and the no-confidence system of the State Council, and the abolition of the presidential term restriction. Opposition lawmakers objected to the revision of the Constitution, citing three points: representative democracy, prevention of administrative dictatorship, and constitutionalism. On the other hand, ruling party lawmakers supported the revision of the Constitution, citing three principles: direct democracy, separation of powers, and situationism. The controversy between ruling and opposition lawmakers was caused by differences in perception of democracy.
