説明

According to the predominant view in the Criminal Law Society of Japan, the criminal competency consists of discrimination and control. The liability of the accused, however, hould be decided only on his discrimination, because his control belongs to the professional province of psychological medicine. The criminal responsibility is a legal concept to the utmost, but not a psychiatric one. It can be judged from the general ethical viewpoint whether the accused could distinguish between good and evil at the time of the crime.
