Abstract

In the research project on old customs and systems conducted by the Japanese Government-General of Korea, four research materials concerning the family system in Korea were published in the 1930s. Here I analyze the three most important materials. In colonial Korea, instead of Japanese family law, Korean common law was applied as family law. Accordingly, the Japanese Government-General of Korea pursued its family system policy in conjunction with a legislative project aimed at amending the family law. This study reveals the impact of the three research materials on the amendment of the family law. Specifically, they proposed that the common law applied as family law in Korea should be reformed into family law typical of Japan as stipulated in the Civil Law of Japan.
