Abstract

This paper examines the Austrian Federal Constitution of 1920 (Österreichisches Bundes-Verfassungsgesetz 1920). This constitution lays the foundations of the current Austrian Federal Constitution. The eminent Austrian jurist Hans Kelsen made different constitution drafts, and several Austrian political parties entered into heated controversies about these. Consequently, a range of views from Austrian people of that time are included in this constitution. On the other hand, the 1920 Austria Federal Constitution also received important concepts such as popular sovereignty, constitutionalism, and equality before the law from the Kremsier Draft Constitution of 1849 (Kremsierer Verfassungsentwurf in 1849), which was written immediately after the Austrian March Revolution of 1848. I describe here the Constitution of 1920, including its writing, contents, the 1929 amendment, the historical background, Hans Kelsen’s views, and Austrian constitutionalism (Legalitätsprinzip).
