Abstract

This paper emphasizes that the significance of visitation for children separated from their parents according to Article 9, paragraph 3 of the Convention on the Rights of the Child is, first and foremost ,the right of the child itself. It is neither the right of the separated parent nor the right of the custodial parent. The discussion examines the best interests of the child by studying the petition filed by the separated father. In doing so, we propose to mandate a system that emphasizes the child’s right to express their opinion.
