The reason why Japan declares the nation built on intellectual property and promotes innovations as the national policy is for Japan to become the winner of the global competition in information technology innovation and to aim at the industrial prosperity and the national prosperity. Japan makes many companies which win in severe intellectual property competitions and is going to establish the technical development power and R&D capabilities of Japan which does not allow imitation of foreign companies. However, the huge companies which got lawful market exclusive rights called intellectual property rights troubles small companies. There are opinions that intellectual property system reduces the technical development power of a country. This paper considers the relation between states and intellectual property systems historically. And it also considers the changes of the intellectual property system of the U.S. which has the advanced intellectual property system. The intellectual property system guarantees the information monopoly only for a specific company over the long period. The Internet society aims at the information share and information disclosure equally. Coexistence of the intellectual property system and the Internet society is very difficult. This paper studies the relation between the state which prospers by intellectual property rights and the Internet society which refuses intellectual property rights. The following conclusions were reached.1)The relation between a state and intellectual property rights can be classified into four, the state without intellectual property systems", the state which accepts the imported patents", the state which also makes small inventions intellectual property rights", and the state which makes only epoch-making and great patents intellectual property rights". 2)We cannot call Japan the state which has adopted the pro-patent policy, as Japan adopted the double standard of invention".3)The Internet society and intellectual property rights cannot live together. Intellectual property rights are the domestic rights for information monopoly. On other hand the Internet society aims at the borderless rights for the information share.4)The intellectual property strategies of the Internet society are the joint development strategy, the standardization strategy, and the know-how strategy.5)The Internet society turns into the society where sharing information" and secret information" live together.
