In our country the cultural products, which have historic, academic and artistic high value, or the ruins made indispensable for formation of national culture are disappearing every year. The fundamental cause is the development priority and the execution of the public works which do not change even if it goes into a low growth time. Especially it seems that "the cause person burden principle" of the excavation investigation expense of the urgent excavation investigation which is carried out in connection with public works etc. has big influence on this problem. Then, I want to explore the problem for how "the excavation investigation expense" of this urgent excavation investigation influences the cause person burden principle through an important judicial precedent.
