Abstract

現代の都市生活において、いわゆるごみ屋敷が社会的な問題となっている。本稿は、最近の裁判例を紹介することにより、第一に、ごみ屋敷が新たな環境問題であることを示し、第二に、これまで展開されてきた都市生活(法)の概念を振り返る。第三に、本稿は、第五次環境基本計画の基本的な考え方である「環境・経済・社会の統合的向上」に参照し、成年後見法を利用することによってごみ屋敷を解消することが可能であり、同基本計画が提唱する「環境と社会の同時解決」が実現できる可能性があることを主張するものである。

The so-called garbage house has become a social problem in contemporary urban life. This article introduces a recent court case related to the issue. By doing so, firstly, I will argue that the garbage house is a new environmental problem. Secondly, I will review the concept of the city life (law). Thirdly, in reference to the Fifth Environmental Basic Plan and its basic concept, “integrated improvement of environment, economy and society”, I will argue that the adult guardianship law could eliminate the garbage house and promote the “integrated improvement” advocated by the Fifth Plan.
