The purposes of this study were to review the articles in the principal laws related with the guarantee of human rights of the handicapped people (the Constitution of Japan, the Fundamentals of Education Act and the Fundamental Law for Disabled Persons) and to reveal problems in education. This study actually analyzed the articles on the handicapped people who are described in the Fundamental Law for Disabled Persons and the Ordinance for the Enforcement of the School Education Law. And it also analyzed the Basic Plans on Human Rights Education. Through the analysis the following 3 viewpoints were revealed as problems of the current education. (1) It is necessary to discuss positively what the definition of the word "handicap" means. (2) Further promotion of the inclusive education for the handicapped and ordinary students is necessary for the future education. (3) It is necessary for qualified teachers to change their awareness of "handicap" and human rights education.
