Japanese Constitution Article 13 has been ruled "All people are respected as an individual. About people's right for Life, Liberty and the Pursuit of happiness needs as much as possible respect on the others national legislation unless contrary to the welfare of the public. These regulations have a defensive nature and function of protection of individual fundamental rights by basic rights for the country, as well as have been set the evidence of positive claims for the responsibility about when the state neglected to protect human rights. This article is to present the direction for a harmonious interpretation of the protection of Constitutional basic righs and the limitations of patent rights that have been disregarded as a reason for the public welfare, from the structure of conflict between patent protection and limits and the people's right to life and health.
