Description

The draft of "Guideline for Identification by Eyewitness in Criminal Investigation" issued by the Committee for Founding Japanese Society for Law and Psychology bans confrontation (i. e., a single lineup or a show up) as a method of identification of a suspect. However, the procedure is widely used by Japanese police to reconfirm a mug shot, and the use of lineup procedure is very rare. On the other hand, in England and Wales, "Police and Criminal Evidence Act : Code of Practice D" gives preference to identification parade. It is said that England police have not used the confrontation as an identification method for the last decade. Based on "Devrin Report" in England which was recently translated into Japanese, we discussed the rationales why confrontations were avoided in England.
