Abstract

The main purpose of this paper is to clarify historical changes in the law and regulations relating to forest practice in Taiwan and their impact on Formosan aborigines. This is important in order to understand the present situation of Formosan aborigines, because the majority live in the mountains. In the history of Taiwan, 4 governments ruled Taiwan from 1624 to 1945. They are Dutch, the Ming and Mandarin dynasties and Japan. Today the Republic of China governs Taiwan. Land development policy and law and regulations of forest practice were studied. A summary of results is as follows. 1)Since the 17 century, many Chinese migrated to Taiwan. During la血d reclamation, they destroyed forests and attacked Formosan aborigines. This is one of the main reasons that Formosan aborigines live in the mountains. 2)The purpose of the first regulation of forest practice in Taiwan was to resolve the conflict between the Chinese settlers and Formosan aborigines. 3)Because Formosan aborigines have a different language, they were often misled by the Chinese. This made Formosan aborigines distrust the government and the law. 4)The Japanese colonial government(1895-1945)enforced forest practice regulations in Taiwan that limited freedom of action of Formosan aborigines and deprived land rights of them. These regulations are still in use today.
