Description

The object of this article is assessing the position of ROE which is a tool of command and control used in military operations under international law. ROE prescribes limitations that apply to the carrying out of a variety of military operations from hostility to law enforcement, taking into consideration military, political, legal factors. ROE was considered hitherto to only reflects regulations under international law. Nevertheless, this article revealed that ROE corresponds with procedural duty under international human rights law and international humanitarian law. This means ROE is more actively involved with international law than was previous thought.
