C・A・ベイリーは『自由の回復』の中で、カルカッタ等における19世紀最初の30年間を「第一次自由主義期」と呼んだ。1820年代にボンベイ管区で生じたボンベイ知事と国王裁判所判事の対立事件は、自由主義思想と植民地支配の現実との間の緊張関係を奇妙な形で反映した。自由主義的な知事と知られたM・エルフィンストンは、J・S・バッキンガム編集の雑誌『オリエンタル・ヘラルド』で、「出版の自由」原理の真の友ではないと繰り返し批判されたが、その原因は知事の行動よりも、バッキンガム本国強制送還の中心人物、J・アダム・インド臨時総督が、知事の従弟だったという血縁関係にあった。イギリスで一部議員がバッキンガムの政治運動を支持したことや、イギリス下院におけるアダムに対する議会調査への言及、イングランド有力政治家系により任命されたボンベイ国王裁判所主任判事と知事との不仲等の偶然的要因により、知事は次第に精神的に追い詰められ、自身に対する弾劾裁判がありうると思いはじめた。インドにおける良心的行動がイギリスで醜聞化されうるという事実が、彼には重荷となった。

C. A. Bayly, in his Recovering Liberties, called the first three decades of the nineteenth century the 'first liberal moment' in Calcutta and in other British entrepôts in Asia. So-called 'Executive Judicial conflicts', which took place in the Bombay Presidency during the 1820s, exhibited outcomes of tensions between the liberal thought and realities of the colonial rule in a very curious way. During those years, M. Elphinstone, a governor who was known as a man of liberal tendencies, was repeatedly denunciated in the Oriental Herald, a journal edited by J. S. Buckingham, for not being a true friend of free press not much because of what he had done but because he was a cousin of J. Adam, the late Acting Governor-General who had played a major role in forcefully repatriating Buckingham from Calcutta. The governor had been psychologically driven into a corner and started imagining that he might be impeached by the parliament due to various coincidences such as some MPs' support of Buckingham's cause against the British East India Company, a reference in the House of Commons to a possible parliamentary investigation against Adam and his frequent conflicts with the chief justice of the local King's Court, who had been appointed by an influential English political family. One of the focal points of his anxieties was that what he had conscientiously done in colonial India could be treated as scandals in his homeland.
