In French constitutional law, one method to reflect the diversity of the actual nation in the political sphere is the national institution composed of socio-professional interest representation, which, however, encounters difficulties regarding its legitimacy and representativeness. The former difficulty lies in procuring legitimacy to overcome the conception since the French Revolution that the nation is composed of equivalent individuals. In examining the arguments of L. Duguit and D. Rousseau advocating for a national institution composed of socio-professional interest representation, it was found that Duguit reconstructed the nation to include groups, while Rousseau established the existence of “citoyen” alongside the nation. The latter difficulty concerns the compromised representativeness due to arbitrariness in the selection of socio-professional interest representation. To determine the method to improve representativeness, an analysis was conducted focusing on recent reforms within France’s national institution composed of socio-professional interest representation, Conseil économique, social et environnemental. The findings suggest that instituting a system to ensure periodic modifications in composition, creating categories related to specific interests, and engaging citizen representatives chosen by lot in activities could potentially contribute to improving representativeness.
