<p> In Japan, the conditions for performing induced abortion are restricted by the Maternal Protection Act, which allows abortion before fetal viability limit, not only for pregnancies resulting from rape, but also in cases in which maternal health cannot be maintained due to physical or economic reasons. In addition, although the applicability of this law is left to the discretion of physicians designated under the Maternal Protection Act, the economic conditions are interpreted broadly, resulting in the well-known fact that induced abortion is in effect practiced freely.</p><p> On the other hand, the Public Assistance Act not only ensures culturally enriched and healthy lives, but also stipulates economic assistance that covers the cost associated with pregnancy in addition to the cost of childbirth in regard to pregnancy and childbirth. Therefore, although questions remain regarding the application of the economic conditions of the Maternal Protection Act, the Ministry of Health and Welfare is approving the application of the economic conditions for women receiving public assistance and notifying welfare offices and social workers to provide the information necessary for determining the applicability of the economic conditions. However, it is not possible for the aforementioned government workers, who are in a position to embody the spirit of the Public Assistance Act, to assert that women receiving public assistance are unable to maintain their health during pregnancy. These government workers and the physicians designated under the Maternal Protection Act therefore face a contradiction.</p>
