Abstract

The author introduces copyright system prior to the Modern Times, studies consequences and current status that two legal thoughts surrounding copyright have brought. Then he discusses how Japanese Copyright Law has dealt with technological innovation as well as international harmonization on the matter. On the other hand the author describes how copyright treaties have incorporated the matters of technological innovation in them, and shows what roles and functions are expected to play in those treaties. Besides he points out how idea of modern copyright law Fukazawa introduced around the time Meiji Restoration had been changed in the course of Japan’s modernization, and how such idea had been shaken in relation to the history as copyright and the neighboring rights have enlarged.
