This article analyzes the enforcement mechanism of the UK’s consumer law on unfair terms in contracts for entering care homes or purchasing retirement properties, which are leased (“leasehold properties”). In comparison to the Japanese mechanism where administrative enforcement is not so strong, the UK’s Competition and Market Authority (CMA) has wide and comprehensive powers, such as those for investigation, consultation and advice to the investigated traders, seeking courts for injunctions or enforcement orders, and criminal prosecution. Because of this legal structure, it is less common for cases to go to court. Most cases are solved through “undertakings” (i.e. voluntary agreements offered by the traders) during the process of investigation. This enforcement mechanism can overcome a “black and white” attitude—namely, illegal or not illegal---and produce favorable consequences that offer, firstly, direct redress to the consumer, and, secondly, provide a practical deterrent to the use of the terms in question, and, finally and most importantly, change general practice in the sector.
