抄録

One characteristic of procedural law in medieval Japan is that in cases where a plaintiff brought a claim for dispossession, the authorities restored such possession without examining the defendant (dispossessor). However, since many institutional differences existed among the various authorities, it is important to determine where those common procedures stood within the framework of each legal system. This article investigates the procedure that existed under the Kamakura Shogunate and the function of the confirmation document (ando) by which the authorities recognized the possession (chigyo) of the feudal lords.
