Whereas States’ duty to cooperate with international organizations where of they are members has been evoked in the case law of international courts, it has been the topic of relatively few investigations in previous studies. In particular, in the situation where no written law is applicable, international courts happened to enforce this duty in connection with the necessity for the fulfillment of organization functions and principle of good faith; but relations between these different notions have yet to be clarified. This paper examines the implementation of such a duty to cooperate in cases of 1） treaty relation, and 2） relation between an international organization and its member states in order to ascertain its actual legal basis. It is found that, although such basis tends to vary from one case to another, the interests of the organization involved are always factored into judgments.
