Abstract

This article examines the law and practice of the asset disclosure order, an ancillary measure to police the freezing injunction (Mareva injunction). These interim measures of protection are available in the English courts but not in the Japanese courts. This article examines the threshold requirements for obtaining these measures as well as the steps to be followed to resist or vary the measures. The strengths and drawbacks of these measures are also considered.
