Description
When a judge decides a judgement, his all judicatory acts must have always legal grounds on the legal reason of Article 76 Paragraph 3 of the Japanese Constitution. Therefore, when a judge interprets a law on the major premise of the judicatory syllogism and also when he uses a burden of proof on the minor premise of the judicatory syllogism, legal grounds are always necessary.
