The Committee on the Elimination of Discrimination Against Women (CEDAW) submitted a recommendation to the government of Japan to amend the civil codein 2003. This paper focuses on one of the 22 categories recommended, which was toremove the discriminatory term "illegitimate child," used to refer to children outside marriage, from official documents. The fourth council, held in July 2009, reported on the progress related to the above recommendation. This paper documents the progress of the court case from the first to the final trial over a three-year period and depicts howthe case was treated with silent contempt and ended with the loss of the lawsuit.
