Abstract

This study verified the significance and effect of clarifying the background and other factors involved in homicides or murder-suicides by family caregivers through expert testimony during the pre-sentencing report system on psychological, sociological, and environmental factors. A case analysis showed that information disclosure, particularly related to negative environmental factors, was enhanced by expert testimonies of psychological, sociological and environmental factors of criminal conduct. Furthermore, the study found that such testimonies provided resources for examination from various perspectives of the "defendant's scope of responsibilities" and also indicated the social and pathological background in which family caregivers lacking skills for providing care are forced by circumstances to do so. Although it may be difficult to involve expert testimony on psychological, sociological, and environmental factors of criminal conduct in homicides or murder-suicides by family caregivers, lawyers can incorporate expert perspectives into a trial if the testimony comprises consulting social welfare specialists and, thus, it enables obtaining the effects of expert testimony on psychological, sociological, and environmental factors of criminal conduct. By involving legal and welfare specialists, the forensic social services principle will be able to become a reality, where legal issues are led to substantial resolution and reconciliation.
