Abstract
The livelihood protection system, which is positioned as the last safety net, obliges the people to guarantee a ”healthy and cultural minimum life”. In the actual operation of the livelihood protection system, several court cases have been filed over the livelihood protection system over the violation of Article 25 of the Constitution. As the number of elderly people, who make up a large proportion of welfare recipients, is increasing, we examined the judicial precedents and theories surrounding Article 25 of the Constitution as to whether Article 25 of the Constitution could serve as the final safety net.
