Abstract

This paper addresses the question whether or not the arbitral award rendered in Japan can be set aside when it has a defect in determination of applicable law to the merits of the dispute. In the author's opinion, the answer is in principle negative in deference to the autonomous character of arbitration, but there are some exceptional cases where the resulting award can be set aside based on Article 44, paragraph 1, item 6 of the 2004 Arbitration Act in Japan.
