[要旨] 死因・身元調査法が施行され，同法に基づく解剖が始まってから4 年が経過した。この新しい解剖の導入が，わが国の死因究明制度にどのような影響を与えたかを考察する。警察庁が公表したデータ，及び千葉大学と東京大学で行われた司法解剖と調査法解剖のデータを用いて解析を行ったところ，以下の結論が得られた。調査法施行前後を比較すると，司法解剖は微減，行政解剖はかなり減少したが，新設の調査法解剖がそれ以上に行われたため，全体の法医解剖数は若干増加した。ただし，新設の調査法解剖は従来から解剖率の高い特定の地域に偏って行われていること，さらに法の運用は各都道府県警によって相違があることが分かった。千葉大・東大の解剖に関して，千葉大では身元不明死体は司法解剖に付されているのに対し，東大では多くの事例が調査法解剖で行われていた。調査法運用上の問題点は解剖以外にも認められる。遺族への配慮，法医学者からの意見聴取，関係機関への通報がいずれも十分でない点等，立法時の主旨が生かされていないと言わざるを得ない。また，診療関連死，自損の交通事故死のように，いまだ調査法が有効に活用されていない分野もある。

[SUMMARY] Four years have passed since the death investigation and identification act was implemented and a new type of autopsy established. We discuss what influences the introduction of these autopsies has had on the death investigation system in Japan. We obtained the following results after analyzing data from the Japan police agency and from medico-legal autopsies in Chiba University and Tokyo University. The number of autopsies generated by the new act overwhelmed the reduction of other types of autopsies, and the total number of medico-legal autopsies increased. However, the autopsies produced by the new act were largely performed in a few areas in which the autopsy rate had been relatively high. Moreover, the application of the act differed according to every prefectural police force. In Chiba the unidentified bodies were autopsied as judicial autopsies, although in Tokyo many of them were autopsied in compliance with the new act. The problems of the application of the new act are also indicated in other issues. Care for the bereaved, consultations with forensic pathologists, and reports to other organizations have not been considered seriously. Further, the new act should be applied more comprehensively to treatment-related deaths and deaths by self-inflicted traffic accidents.\n
