Abstract

In this article, I examine two important books on property theory recently translated into Japanese : Michael Heller’s Gridlock Economy（2008）and Eric A. Posner and E. Glen Weyl’s Radical Markets（2018）. Although the two books differ in their themes and prescriptions, they share a strong commitment to the idea of allocative efficiency of resources and a rather negative evaluation of the prevailing market system on this point. After criticizing some of their excessive claims, I apply their genuine insights to contemporary Japanese property rights scholarship.
