Abstract

This paper presents four of the civil court records compiled at the Kori-bugyo-yakusho(county magistrate's office) in Tango-Tanabe-Han in the late Edo period. Court records are made up of two parts, kujideiri-ginmimono-nikki and kujideiri-ginmimono-sintatsu-hikae.The former consists of court journal with transcripts of documents for submission, and the latter consists of the thecircular letters by bugyo (magistate) asking permission of the karo (senior ranking retainer) on duty. The documents are composed of a detailed résumé of the cases, the concerned clauses of Kujikata-Osadamegaki as authority, the citable precedents, the reason of decision, and the decision, to which a reply by karo is often attached.The records presented here are those of processes and decisions of the cases cocerning succession of patrimony and possessory actions from the other domain, mortgage and common. Through these historical sources, we can perceive that interpretation of clauses of Kujikata-Osadamegaki as authority and written documents as evidence were the top priority in the decision making process then.
