Abstract

Rashīd Riḍā has a significant influence on contemporary scholars who are studying maqāṣid al-Sharī‘ah (the objectives of Islamic law). Yet these scholars have different views on maqāṣid al-Sharī‘ah, and they are not all equally influenced by Riḍā. Concerning human rights, we notice two distinct ways in which Riḍā influences maqāṣid scholars. First, some of them follow Riḍā’s view as to what rights should be guaranteed: they call for reforms of Islamic jurisprudence with regard to religious freedom, whereas, in gender-related issues, they maintain their traditional belief about the different roles that men and women should play, and consider this belief superior to the Western idea of absolute equality between genders. Second, others are influenced by Riḍā’s legal methodology: they claim that changing contexts should be considered when interpreting revealed scripture, especially with regard to gender. Thus, Riḍā’s methodology has been used to justify arguments that are against his own and has contributed to the emergence of a variety of maqāṣid theories.
