本稿は，渋谷温泉施設爆発事件（最一決平成28年5月25日刑集70巻5号117頁）で示された大谷直人裁判長の補足意見を契機として，過失犯における「因果経過の基本的部分」の予見可能性の問題について予備的考察を行ったものである。まず，渋谷温泉施設爆発事件における判例の内容を確認した。次に，「因果経過の基本的部分」が問題となった判例の検証を行うとともに，この問題に関する学説について分析をした。具体的予見可能性説の立場からは「因果経過の基本的部分」の予見可能性が必要としながらも，その基本的部分の内容および予見の程度を抽象化することで，危惧感説（抽象的予見可能性説）と限りなく近いものになる。さらに，「因果経過の基本的部分」は不要であるとする見解も示されている。そこで本稿は，これまでの判例・学説の分析・検討を行ったうえで，危惧感説（抽象的予見可能性説）の立場から「因果経過の基本的部分」の予見可能性について検討する。This paper considers the foreseeability of the basic part of causality course of the negligence based on the Supreme Court of Japan Decisions,Judgment of May 25,2016（Supreme Court criminal case collection Vol.70,No.5,page117.）The negligence is careless. In other words,it is the breach of duty of care.Many precedent cases interprets the contents of these duties as"the duty to avoid risk",and a foreseeability requires as the premise of the duty to avoid risk.The judgments and theories makes the predictability subjects"the result of constituent element"and"the basic part of causality". By the way,the precedent on the foreseeability of"the basic part of causality course" is worthy of note recently.So this paper examines preliminary about a foreseeability of"the basic part of causality course"based on a precedent.
