The Code of Criminal Procedure enacted in 1948 established a new provision on the right to remain silent. Are the statements made by the defendant in court as claims of a party or as evidence? This ambiguity remained from the beginning of the legislative process. However, the scope of silence was examined in conjunction with a provision that did not require the accused to specify his or her claims or contentions. As a result, the right to remain silent may have been positioned as something that can comprehensively refuse to give a statement. During deliberations in the Japanese Diet, the purpose of guaranteeing a comprehensive right to remain silent was to redefine the status of the accused under the old law and to ensure the accused’s status as a party to the case. It was also intended to encourage investigative authorities and prosecutors to prove their case without relying on the defendant’s statements.
