抄録

This paper examines the situations in which the prerogative powers and statutes may conflict, and how the courts reconcile the relationship between them, and thus between the Government and Parliament, in these situations. First, this paper discovers that exercising prerogative powers has been illegal in all cases where there has been dissent from Government backbenchers. Secondly, this paper finds that in such situations, the courts have ruled these exercises to be illegal, thereby indicating that the consent or rebellion of Government MPs should be confirmed through legislation. Based on this analysis, this paper argues that it is necessary to re-examine British parliamentary government in terms of Government backbenchers.
