Abstract

In China, multiple systems have been created and implemented for environmental restoration, which includes the removal of pollution and restoration of natural resources. The Polluter-Pays Principle(Sunhaidanze in Chinese)is applied through environmental public interest litigation, eco-environmental compensation, and administrative orders. In addition to legislating to provide for the Polluter-Pays Principle, the government engages in restoration of the environment at its own expense. The fact that the scope of the Polluter- Pays Principle and the governmental burden of environmental restoration is not clearly defined possibly obstructs making the polluters themselves bear the costs of restoration. The currently available data reveals both the insufficiency of compensation and the lack of institutions to utilize compensation for restoration. As it is impossible to judge to what extent the polluter bears the burden of the cost of restoration, further research on these matters is required.
