This article analyses the process by which the EU-commissioned “Independent International Fact-Finding Mission on the Conflict in Georgia” found(il)legality of armed activities of the warring parties. The analysis aims to identify the socio-legal significance that this process conveys given the reality that States resorting to force are rarely subject to legal scrutiny by competent organs on the international plane and thus able to eschew the constraint of international law. It is an attempt to explain the investigative activities of the Mission from the perspective of sociology of law, focusing on a function that the Mission performed : public accountability. Applying this methodology, the author demonstrates that the Mission’s activities represent a process of public accountability for the conformity to the law regulating the resort to force. This is shown by the fact that the interactions between the Mission and the warring parties functioned in such a manner as to induce the latter to present more legal discourses by reconceptualisation, reformulation, and elaboration of their positions regarding the use of force. The conclusion suggests that the public accountability process of the Mission may work as a countervailing force against the abuse of power, placing the warring parties under the constraint of international law.
