Abstract

This paper is a review article on the digitalization of administrative justice in Italy. In Italy, three issues are discussed regarding digital administrative justice :(1)the digitalization of administrative decisions, which form the basis of administrative justice, particularly the possibility of using algorithms in decisions and the criteria for their control by the courts ;(2)the digitalization of court procedures ; and(3)the digitalization of judgments, particularly the possibility of using algorithms in judgments. The Italian discussion deserves attention in the following respects. Regarding(1), the State Council provides specific control criteria for decisions using algorithms. Regarding(2), a range of issues has emerged, both in the IT practices of courts and in the precedents set by the State Council. Regarding(3), along with theoretical considerations, the Prodigit project implements predictive justice in tax litigation, representing an emerging trend that warrants future attention. All of these are worthy of reference when discussing the digitalization of administrative justice in Japan.
