米国では，2010年にFCCが最初のネット中立性規則を制定したが，訴訟や政権交代によってたびたび方針転換を強いられている．民主党バイデン政権下のFCCは，第1次トランプ政権時代に無効とされたネット中立性規則を復活させるとともに，ブロードバンドサービスを電気通信サービスに再分類することを提案した．FCCは，ブロードバンドの再分類は国家安全保障および公共安全の観点からも必要であることを強く訴えている．FCCは2024年4月，ネット中立性規則の復活とブロードバンドサービスの再分類を決定したが，通信業界団体による訴訟の結果，裁判所はFCCの決定を無効とする判決を下した．

In the United States, the FCC enacted its first net neutrality rules in 2010, but lawsuits and regime changes have often forced the FCC to change course. Under the Biden administration, the FCC has proposed reinstating net neutrality rules that were vacated during the first Trump administration and reclassifying broadband service as a telecommunications service. The FCC argues that reclassification is necessary considering national security and public safety. In Apr. 2024, the FCC decided to restore net neutrality rules and reclassify broadband service as a telecommunications service, but as a result of a lawsuit, the FCC's decision was invalidated by the court.
