Abstract

<p>Along with the establishment of the People’s Republic of China (1949), the sovereign theory has been defined as “Peoples’ Sovereignty”, which forms the basis of the principle of socialism (communism) stipulated in the current constitution as a communist ideology. However, the sovereign theory has been reinvigorated once again with the rapid development of globalization since the 1990s, and the theory of “traditional sovereignty” in the fields of international relations and international law has rapidly been transformed in line with the development of human rights, humanitarian interference, democratization support to developing countries, global governance, economic globalization, etc.. Under these circumstances, the idea of sovereignty has been considered to be outdated, and new trends in search of redistribution of sovereignty, the end of the Westfalia regime have recently emerged. Controversy over sovereign theory has been actively held, as the search for new sovereign theories rapidly expanded in China. The current economic diplomacy strategy of “One Belt, One Road” (Chinese development strategy) as a Chinese-led “reverse globalization” prompted by Xi Jinping regime has been put forward vigorously. This paper attempts to demonstrate how the theory of “traditional sovereign” under the one-party dictatorship system is theoretically viewed in relation to C. Schmidt’s constitutional as well as political theory, which is becoming increasingly influential in contemporary China.</p>
