Description

In recent years, it has become easy for everyone to engage in social sanctions, such Internet or SNS slandering. Social sanctions are regarded as unlawful sanctions against and obstacles to criminals’ reintegration into society. Why do social sanctions exist despite legal punishment? According to previous studies, there is a complementary relationship between legal sanctions (penalty) and social sanctions, with legal sanctions potentially promoting (or suppressing) social sanctions. In this study, two experiments were conducted with the aim of verifying the complementarity of legal and social sanctions against criminals in criminal cases. As a result, the complementarity of legal and social sanctions with regard to the influence of objective indicators (the strength of social and legal sanctions) was not confirmed, although it was suggested with regard to subjective evaluation (cognition of strength of social and legal sanctions). Therefore, it is thought that objective complementarity of legal and social sanctions can be realized by influencing the subjective evaluation of people against the suppression of social sanctions. In order to solve the problems caused by social sanctions, in the future, it is necessary to examine factors that affect people's subjective evaluation.
